1. Introduction

Welcome to our pharmaceutical services. These Terms and Conditions govern your use of our website, services, and products. By accessing our website or using our services, you agree to be bound by these Terms and Conditions.

In these Terms, "we," "us," and "our" refer to Benique Healthcare, and "you" refers to you, the client, customer, or user of our website or services.

2. Services

We provide pharmaceutical services to healthcare facilities, pharmacies, and authorized medical distributors. Our services include but are not limited to distribution of prescription medications, over-the-counter products, specialty pharmaceuticals, hospital supplies, and related logistics services.

All clients must provide proof of appropriate licensing and authorization to purchase and distribute pharmaceutical products in accordance with federal, state, and local regulations.

3. Ordering and Payment

Orders may be placed through phone, or via email. All orders are subject to approval and availability. We reserve the right to reject any order for any reason, including but not limited to compliance concerns or credit issues.

Payment terms are net 30 days from invoice date unless otherwise agreed in writing. We accept payment via electronic funds transfer, credit card, or company check.

4. Shipping and Delivery

We will use commercially reasonable efforts to meet requested delivery dates. Delivery dates are estimates only and not guaranteed. We are not responsible for delays caused by carriers, force majeure events, or circumstances beyond our reasonable control.

Risk of loss transfers to you upon delivery to the carrier. You are responsible for inspecting all products upon receipt and reporting any damage or discrepancies within 48 hours of delivery.

5. Product Returns

Returns of non-defective products may be accepted within 30 days of delivery, subject to a 15% restocking fee. All returns must be authorized in advance and include original packaging and documentation.

Returns of temperature-sensitive or controlled substances are subject to additional restrictions and may not be eligible for return. Defective products will be replaced or refunded at our discretion.

6. Compliance and Regulatory Matters

All clients must comply with applicable laws and regulations governing the purchase, storage, and distribution of pharmaceutical products, including but not limited to FDA regulations, DEA requirements, and state pharmacy laws.

We maintain appropriate licenses and comply with all applicable laws and regulations, including current Good Distribution Practices (GDP). We reserve the right to report suspected violations of law to appropriate authorities.

7. Limitation of Liability

To the maximum extent permitted by law, our liability for any claim arising out of or related to these Terms shall not exceed the amount paid by you for the products or services giving rise to such claim. We shall not be liable for any indirect, special, incidental, or consequential damages.

8. Indemnification

You agree to indemnify, defend, and hold harmless our company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of our services or products, or your violation of these Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your State], without giving effect to any choice of law principles. Any dispute arising out of or related to these Terms shall be resolved exclusively in the state or federal courts located in Delhi, India.
